Bike for Women
Assumption of Risks & Release of Liability for Negligence
PLEASE READ CAREFULLY – THIS IS A WAIVER OF LEGAL RIGHTS
Riding a bicycle and participating in a cycling event, like the Bike for Women, that traverses public roads and trails is a risky activity. These risks include the risks inherent in riding a bicycle in traffic - potentially negligent driver - the possibility of an accident with traffic, uneven surfaces or confusing signage -traversing trails with varying surfaces – weather – wildlife – pedestrians - other riders. You can fall, be hit by a car, ride off the road, be hit by a fellow bike rider, be attacked by a bear or a moose, or be injured by a variety of risks that exist in the world. By signing this Assumption of Risks & Release of Liability for Negligence, I voluntarily assume all risk of death, physical or mental injury, or property damage associated with my participation (or my CHILD’s) in the Bike for Women.
By agreeing to participate in this ride (or allowing my CHILD to participate), I ALSO voluntarily accept the risk that the organizers may be NEGLIGENT in their performance of their duties associated with putting on a group ride. This negligence is beyond the inherent risks of Alaska bicycle riding or group rides. This risk is the reality that the organizers do not claim to be perfect nor able to anticipate all dangers or risks that may befall participants. Organizers may make a mistake and that mistake may result in injury or death. In consideration of being allowed to participate in this ride I accept the risk that I (or my child) may be killed or injured and waive any right to sue the Arctic Bicycle Club, its officers or volunteers for any NEGLIGENCE on their part.
As it applies to my participation (or my child’s) in this race, I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases, and I attest to having read the CDC’s guidance How to Protect Yourself and Others. I assume all such risks being known, appreciated, and accepted by me. In addition, I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume the risk that I (or my child) may be exposed to or infected by COVID-19 and/or other communicable diseases by participating in this event. I acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 in connection with my (or my child’s) participation in this event and personally assume this risk. I acknowledge that the in person event may be cancelled at any time at the discretion of the Event, or the direction of permitting agencies and health officials.
Further, I grant permission to the Arctic Bicycle Club to use my (or my child’s) name, voice and images of myself (or my child) in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
In plain and simple language: If you do not want to assume all of these risks and forever release the Arctic Bicycle Club, do not sign this document and do not participate in the Bike for Women.
I am aware that this Release of Liability and Assumption of Risks is a binding contract between me and the Arctic Bicycle Club. I am signing this release on my own behalf (or my child’s) and on behalf of my heirs and assigns.
